CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA

Within the scope of the Law No. 6698 (KVKK for TR Citizens) on the Protection of Personal Data, our Company, as the data controller, will record, classify, process, store, update, transfer and disclose the personal data of our valued customers to third parties. With this information, we hereby inform you about our mutual rights and obligations in accordance with the provisions of the Law.

Your personal information refers to all kinds of information that will enable you to be identified or identifiable, such as identity information (name, surname, Turkish ID number, etc.), address and telephone information, vehicle and license plate information, real estate information, bank account information, family status information, voice and image.

DEFINITIONS RELATED TO KVKK

KVKK Law No. 6698 on the Protection of Personal Data

• Explicit Consent: Consent on a specific issue, based on information and expressed with free will.
• Anonymization: Making personal data impossible to be associated with an identified or identifiable natural person under any circumstances, even by matching with other data,
• Relevant Person: The natural person whose personal data is processed,
• Personal Data/s: Any information relating to an identified or identifiable natural person,
• Processing of Personal Data: All kinds of operations performed on personal data such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data by fully or partially automatic means or by non-automatic means provided that it is part of any data recording system,
• Board: Personal Data Protection Board,
• Institution Personal Data Protection Authority,
• Data Processor: The natural or legal person who processes personal data on behalf of the data controller based on the authorization granted by the data controller,
• Data Recording System: The recording system where personal data is structured and processed according to certain criteria,
• Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system,
• Sensitive Personal Data: Data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership to associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, and biometric and genetic data.

1. The method of collecting your personal data:Your personal data is collected through various channels, including our website, our representatives, branches or workplaces, or through the information you transmit to us via e-mail, fax, telephone, text message or other means, through the identification system called “cookies” that allows our computers to automatically recognize you when you visit our website, through various channels, including sources such as the trade registry, through various methods that are fully or partially automated or non-automated as part of any data recording system, whether verbally, in writing or electronically.
2. Personal Data We Process: The personal data processed in the capacity of data controller include, but are not limited to, the following;

3. The purposes and legal reasons for processing your personal data:Your personal data will be processed for the purposes of recording your identity information, address, tax number and other information in order to identify the transaction owner and addressee in all kinds of business and transactions to be carried out in relation to all kinds of products and services we will offer you, arranging the information and documents that will be the basis of the business and transactions to be carried out on paper or electronically, complying with the information storage, reporting and information obligations stipulated by all judicial and administrative authorities in accordance with the relevant legislation, and fulfilling the contracts between us and the service we will provide to you. Transfer of your personal data:Your personal data may be transferred to our shareholders, domestic/foreign subsidiaries, consultants, lawyers, program partner institutions, organizations, domestic/foreign companies, persons and institutions from which we receive services to carry out our activities, persons and institutions from which we receive data storage services in the cloud environment, institutions that we have contracted to send the messages we send to our customers, domestic and foreign banks (including correspondent banks), financial institutions, payment institutions and other third parties with whom we cooperate or receive services within the framework of our relevant cooperation. Your information may be transferred to legal authorities and institutions at the request of official authorities or in cases where there is an obligation to provide information in accordance with the legislation, and they may also share your information separately.

6. Retention and security of personal data:Personal data will be retained for as long as the purpose for providing this information is valid. Your data will continue to be processed by us after the expiration of the service you have received from us in order to determine your needs related to our field of activity and to serve you more quickly. These limits will be respected if the data must be retained subject to legal deadlines and for reporting and information purposes to legal authorities and other relevant public authorities. Necessary security measures will be taken by us to prevent the loss of stored and recorded data, to prevent unauthorized access and to prevent unlawful use.

7. Your rights under the Law:Article 11 of the Law Pursuant to Article 7 of the Law, by applying to our company; to learn whether your personal data has been processed, to request information about it if it has been processed, to learn the purpose of processing and whether it is used in accordance with its purpose, to know the third parties to whom it has been transferred domestically or abroad, to request correction in case of incomplete or incorrect processing. You have the right to request the deletion or destruction of personal data within the framework of the conditions stipulated in the article, to request the third parties to whom it is transferred to be notified of the transactions made within the scope of the aforementioned correction, deletion or destruction, to object to the emergence of a result against you by analyzing it exclusively through automated systems, and to demand the compensation of the damage in case you suffer damage due to processing in violation of the Law.

You may submit your questions and requests about your personal data by means of a petition or“Application Form” prepared in accordance with the conditions specified in the Communiqué on the Procedures and Principles of Application to the Data Controller and the methods specified below. As the Data Subject, you may submit your questions and requests regarding your personal data to our Company’s address “Mustafa Kemal Mah. Dumlupınar Blv. 280/1202 ÇANKAYA / ANKARA” with a notary public notice or by submitting your personal application by presenting your identity card. Your requests will be evaluated and decided free of charge as soon as possible and ultimately within 30 (thirty) days at the latest. Following the application you have made to our company, if you are not satisfied with the response to the application in question, it is a right granted to you by law to apply to the Personal Data Protection Authority for a complaint.
